    Service Terms and Conditions

    For clarity purposes, this platform operates under the name “ButterflAI”, which corresponds to the registered trademark “ButterflAI Art”, owned by PIXELITY LABS S.L.. Both designations may be used interchangeably in this document, on the platform, and in any other communication related to the service.

    1. Acceptance of Terms

    • By accessing and using the ButterflAI Art platform (https://butterflai.pro), developed by PIXELITY LABS S.L. (the “Company”, “we” or “our”), you (“the User”) agree to be legally bound by these Terms of Service (the “Terms”), as well as by the Privacy Policy.
    • If you do not accept these Terms, you must refrain from using our services.

    2. Service Description

    • ButterflAI Art is a SaaS platform that uses artificial intelligence technology to help online stores optimize their product sheets, allowing:
    • Image upload and editing (background removal, substitutions, corrections).
    • Automated generation of titles, descriptions, attributes, and SEO metadata.
    • Application of specific “AI agents” to each product.
    • Access to these functionalities is structured through a subscription plan system that grants a monthly number of credits, which the User can freely consume according to their needs.

    3. Registration and Access

    • Using the platform requires creating a personal account, for which the User must provide truthful and up-to-date information, including their ecommerce URL, sector, and other related data.
    • The User is responsible for protecting their password and all activity that occurs under their account.

    4. Plans, Subscriptions and Billing

    1. Types of plans

      • Free
      • Basic
      • Premium
      • Enterprise/Custom

    2. Monthly and annual renewal

      • Monthly subscriptions: credits are automatically renewed each month on the billing date.
      • Annual subscriptions: a single annual payment is made, but credits are allocated and renewed monthly, not in full at the start of the cycle.

    3. Upgrades and plan changes

      • The User can change plans (upgrade or downgrade) at any time.
      • In case of upgrade, the original billing date is maintained.
      • The amount to pay will be proportional to the difference between the new plan and the previous one, and the remaining time in the billing cycle.
      • Example: If a User pays for the Basic plan on April 15 and wants to switch to Premium on April 30, they will only be charged the proportional part corresponding to the remaining days until May 15.

    4. Subscription cancellation

      • When canceling a paid subscription, the User will maintain access and their remaining credits until the end of the already paid period.
      • At the end of the cycle, the account will automatically change to the Free plan, preserving all data.
      • No refunds will be made for unused periods.

    5. Content Ownership

    1. The User will retain all rights to:

      • The images they upload.
      • Texts generated through AI agents.
      • Any other content generated or processed through the Service.

    2. The User grants us a limited license to use said content solely for operational purposes, that is, to provide the requested services.

      6. Acceptable Use and Prohibited Content

      1. The User agrees not to use the service to:

        • Create, upload or distribute illegal, offensive, violent, discriminatory content or content that infringes third-party rights.
        • Automate content for spam, phishing or misinformation.
        • Use the platform fraudulently, abusively or to violate local or international laws.

      2. Consequences of non-compliance:

        • The Company may suspend or cancel accounts that violate these rules.

      7. Third-Party Technologies and Limitations

      1. ButterflAI Art is based on third-party APIs. The User accepts that:

        • Part of the generated results depend on third-party systems.
        • The Company does not guarantee the accuracy, legality or suitability of results generated by artificial intelligence.

      8. Service Availability

      The Company does not guarantee uninterrupted service availability. Technical stops may be performed for maintenance or interruptions due to causes beyond our control.

      9. Account Cancellation and Data Deletion

      • The User can delete their account at any time from their control panel or through written request.
      • Upon account deletion, all data will be removed from the system within a maximum period of 15 calendar days.
      • During that period, the account will be deactivated and inaccessible.

      10. Limitation of Liability

      1. The Company will not be liable, under any circumstances, for:

        • Indirect, incidental, punitive or consequential damages.
        • Loss of profits, revenue, data or reputation.
        • Decisions made based on content generated by the system.

      2. The maximum cumulative liability will be limited to the amount paid by the User during the last 12 months.

        11. Modification of Terms

        We reserve the right to modify these Terms at any time. The User will be notified through their registered email or through the platform. Continued use implies acceptance of the new Terms.

        12. Applicable Law and Jurisdiction

        These Terms will be governed by Spanish law. Any dispute will be submitted to the Courts and Tribunals of Madrid, unless the law establishes another jurisdiction.
